Tokyo Prosecutors’ Office indicts malice manager ~ forcing excess work hours, unpaid overtime




 Tokyo Prosecutor’s Office indicted KOJIMA Itsunari, board of directors, of HBS, a subsidiary of a transport company Tama Milk Group on Dec. 24 for violating Labor Standards Law Article 32. The company forced workers to put in more hours than what the 36 agreement on overtime stipulated, according to the office. The violation of the 36 agreement is punishable by imprisonment for less than six months or fine for less than 300,000 yen. It is extremely rare for a prosecution to send papers on a labor-related case or indict an individual. However, as the company executive was indicted, the prosecutors considered the seriousness and maliciousness of this crime. (By SUDA Mitsuteru, National Union of General Workers, Tokyo Tobu)

 固 定残業代制度を悪用し違法な長時間労働をさせたとして、東京地検は昨年1224日付で、森永乳業東京工場などの下請けの運送会社である多摩ミルクグルー プの「株式会社エイチ・ビー・エス」(東京都葛飾区)と同社の小島逸成(こじま・いつなり)取締役を労働基準法第32条違反の罪で起訴しました。東京地検 などによると、同社らは時間外労働に関する協定(36協定)の限度を超えて長時間労働を行わせていたことなどです。同条違反は6カ月以下の懲役または30 万円以下の罰金に処せられることになっています。労働事件が送検されたり起訴されたりすること自体極めて珍しいことですが、それが今回は送検・起訴にまで 至ったということは、それだけ同社の行為の悪質さを捜査当局が重く見たものと思われます。(東京東部労組・須田光照) 詳細 *写真=社前で「労働基準法を守れ!」と声あげる(201512月1日)
